Ashish Mishra, son of Union Minister Ajay Kumar Mishra, was released from Kheri District Jail on Friday. Confirming the release of Ashish Mishra from jail, Senior Superintendent of Kheri District Jail Vipin Kumar Mishra said, ‘Ashish Mishra was released from jail after receiving the release order from the Sessions Court.’ The Supreme Court on Wednesday granted interim bail for 8 weeks to Union Minister Ajay Kumar Mishra’s son Ashish Mishra in the 2021 Lakhimpur Kheri violence case. A bench of Justice Suryakant and Justice JK Maheshwari directed that Ashish shall not reside in Uttar Pradesh or Delhi during the period of this interim bail.
There is no permission to stay in UP and Delhi
A bench of Justice Suryakant and Justice JK Maheshwari had directed that Ashish would neither be able to live in Uttar Pradesh nor Delhi during the period of interim bail. The bench said it is issuing certain interim directions to further the interest of justice and to decide on an ‘experimental basis’ whether there is any merit in the apprehensions raised by the state and others. The bench exercised its constitutional powers on its own and directed the release of the four accused (Gurwinder Singh, Kamaljeet Singh, Gurpreet Singh and Vichitra Singh) on interim bail till further orders. These accused were arrested in connection with a separate FIR.
The apex court said, “The petitioner (Ashish Mishra) is directed to be released on interim bail initially for eight weeks on furnishing a bond to the satisfaction of the trial court.” “In order to keep the witnesses who are yet to depose from any direct or indirect influence, the petitioner is directed to leave the State of Uttar Pradesh within one week from the date of his release on interim bail,” it said. ‘ It said, ‘Any attempt by the petitioner, his family or supporters to influence or threaten the witnesses directly or indirectly will lead to cancellation of the interim bail.’
Must hand over passport
The bench said that Ashish will surrender his passport to the trial court and will enter Uttar Pradesh only to attend trial court hearings. The court said that Ashish will inform the lower court and the concerned police station within a week of his release, at which place he will stay during the period of interim bail. The bench said that he would mark his attendance once a week in the police station under whose jurisdiction his residence would fall during the period of interim bail. It said that the four accused in another case of murder of three people traveling in an SUV that allegedly ran over farmers should also be released on interim bail on furnishing a bond to the satisfaction of the trial court.
What is the matter
Eight people were killed in the violence that took place on October 3, 2021, during farmers’ protest against the visit of the then Deputy Chief Minister Keshav Prasad Maurya at Tikunia in Lakhimpur Kheri district. According to the Uttar Pradesh Police FIR, four farmers were run over by an SUV and Ashish was sitting in this SUV. After this incident, the driver of the SUV and two Bharatiya Janata Party (BJP) workers were allegedly beaten to death by angry farmers. A journalist also died in the violence.
The Lucknow bench of the Allahabad High Court had rejected Ashish Mishra’s bail plea on July 26 last year, following which he challenged the order in the Supreme Court. Apart from Ashish Mishra, the 12 other accused in the case are Ankit Das, Nandan Singh Bisht, Latif Kale, Satyam alias Satya Prakash Tripathi, Shekhar Bharti, Sumit Jaiswal, Ashish Pandey, Lavkush Rana, Shishu Pal, Ullas Kumar alias Mohit Trivedi. Rinku Rana and Dharmendra Banjara are involved.
