In the Lakhimpur Kheri violence case, the Uttar Pradesh government told the Supreme Court that it had opposed the bail plea of accused Ashish Mishra. Also apprised the court that the eyewitness of the incident had seen the accused Mishra running away from the spot and this is also mentioned in the charge sheet. The Uttar Pradesh government said in the court that the crime is of a serious category and in such a situation, granting bail to the accused can have a bad effect on the society. Supreme Court is hearing the bail plea of Ashish Mishra, accused in the Lakhimpur Kheri violence case. Ashish Mishra has filed a petition in the Supreme Court against the decision of the Allahabad High Court, in which the High Court refused to grant bail to Ashish Mishra in the violence case.
When the Supreme Court asked the reason for opposing the bail plea, Uttar Pradesh government’s Additional Advocate General Garima Prasad told a bench of Justice Suryakant and Justice JK Maheshwari that the crime is of a serious category and granting bail to the accused would send a wrong message to the society. Senior advocate Dushyant Dave appeared in the court on behalf of the people opposing the bail plea of Ashish Mishra. Dushyant Dave also said that giving bail to the accused would send a wrong message to the society. He said it was a conspiracy and a well-planned murder. Dave said that the accused is the son of an influential person and his case is also being fought by strong lawyers.
Senior advocate Mukul Rohatgi appeared in the court on behalf of accused Ashish Mishra and opposed Dushyant Dave’s argument and said who is he? How powerful is it? Is this a reason for not giving bail? Mukul Rohatgi argued that his client has been in jail for more than a year and the way the trial is going, it will take 7-8 years to complete. He said that Jagjit Singh, who has complained in the matter, is not an eye-witness and his complaint is based only on hearsay. Mukul Rohatgi also said that his client is not a criminal and does not have any criminal history. After the hearing, the Supreme Court has reserved the decision on the bail plea of Ashish Mishra.
