Allahabad High Court: In a significant ruling, the Allahabad High Court has recently asserted that the freedom to choose or alter one’s name is a fundamental right as per the Indian Constitution. This decision marked a momentous step in acknowledging personal identity rights within the country.
Case Background: Md Sameer Rao vs UP Board
The case in question was initiated through a writ petition by an individual named Md Sameer Rao. His earlier name, “Shahnawaz”, was registered on his secondary school and pre-university certificates, which were granted by the UP Board in the years 2013 and 2015 respectively.
He had legally changed his name to Md Sameer Rao in 2020 and subsequently applied to the Board to amend his certificates. The UP Board rejected his application, leading to his petition in the Allahabad High Court.
The Court’s Ruling: Asserting Identity Rights
Justice Ajay Bhanot was presiding over this crucial case. He discerned that the liberty to select or modify one’s name is encompassed within the scope of Article 19(1)(a) (pertaining to freedom of speech and expression), Article 21 (concerning the right to life and personal liberty), and Article 14 (which addresses the right to equality) of the Indian Constitution.
The court condemned the authorities’ arbitrary rejection of the name change application, stating that their actions violated the petitioner’s fundamental rights.
Challenging the Status Quo: Timing of Name Change Application
The UP Board had argued that their regulations stipulated an application for name change must be filed within three years of the candidate’s examination appearance. However, Rao’s application came seven years and five months post his high school and intermediate examinations. However, the court negated the Board’s stand, stating that such restrictions are disproportionate and fail to pass the test of reasonable constraints on fundamental rights
A New Precedent for Identity Rights
This landmark ruling by the Allahabad High Court has set a new precedent for the right to personal identity in India. By asserting the fundamental right to choose and alter one’s name, the court has significantly strengthened the framework of personal liberty rights in the nation.
